1. The INFINIDENT production center and its INFINIDENT website

1.1 Our service allows you to order the manufacture of dental workpieces such as crown and bridge frameworks ("dental prostheses") or physical working models ("models") online with INFINIDENT Solutions GmbH ("INFINIDENT "). The purpose of this website is to provide information on the INFINIDENT production center and to allow you to order the manufacture of dental prostheses.
 
1.2 A part of the website, which is accessible to any user, contains descriptions of the options which INFINIDENT offers you. You can obtain information on the operations, products and other conditions of INFINIDENT. In addition, INFINIDENT would like to keep you informed regarding its latest products and events.
 
1.3 When you register as a user, you can order the manufacture of dental prostheses online via the INFINIDENT website. All pages that are specifically for ordering are accessible only to registered users of the website.

2. Applicability and subject of the Terms and Conditions of Use

9. Limitation of liability

9.3 INFINIDENT shall be liable for damages occurring to you, whether due to breach of contract or improper action, only according to the following provisions:
 
9.4 INFINIDENT shall be liable according to statutory regulations in case of intent, claims arising from the product liability act and in case of injury to life or limb.
 
9.5 In cases of gross negligence, INFINIDENT 's liability shall be limited to typically foreseeable damages; this limitation shall not apply with respect to consumers or if the damages were caused by executive employees of INFINIDENT.
 
9.6 In cases of slight negligence, INFINIDENT shall be liable only if an essential contractual duty has been neglected. In such a case, liability is limited to typically foreseeable damages. Any liability shall be excluded in all other cases involving slight negligence.
 
9.7 All claims for compensation for damages or reimbursement for expenses against INFINIDENT expire, provided INFINIDENT is not responsible for any intentional or grossly negligent action, it is not a matter of loss of life, bodily injury or damage to health and there is no claim arising from the product liability act, after 2 years from the time when the claim arose and you have knowledge of it or must have had knowledge of it, excluding gross negligence. Without consideration of your knowledge or in case of grossly negligent lack of knowledge, such claims expire no later than 6 years from when they arose.

10. Place of jurisdiction and applicable law

10.1 The place of jurisdiction, insofar as the parties are merchants, is INFINIDENT's registered office. INFINIDENT is entitled, however, to take legal action against you at your general place of jurisdiction.
 
10.2 German law shall apply.

11. Severability clause

Should any one provision of these Terms and Conditions of Use be ineffective, the other provisions shall remain unaffected. The ineffective provision shall be replaced by one that comes as close as possible to the meaning and intent of the ineffective provision in a legally effective manner. The same applies to any loopholes or omissions.
